These Terms and Conditions are a legal agreement between you and Movement 4 Life Physical Therapy, LLC, a Missouri limited liability company doing business as ‘More 4 Life’ and ‘Over Fifty Coach’ (collectively referred to as ‘the Company’, ‘we’, ‘us’, or ‘our’). By accessing this website or purchasing our services, you agree to these terms. Please read them carefully.
1. Educational Coaching vs. Physical Therapy
Dr. Dave Candy, DPT (a.k.a. David Candy) is a licensed Physical Therapist in the state of Missouri. However, the services provided through Over Fifty Coach are strictly educational and wellness-oriented coaching.
- No Medical Advice: The content on this site and the coaching services provided are for informational purposes only. They do not constitute medical advice, diagnosis, or treatment.
- No Provider-Patient Relationship: Your use of this site, or your purchase of coaching sessions, does not create a provider-patient relationship or a physical therapy relationship.
- Jurisdiction: Physical therapy services are only provided to individuals physically located in Missouri under a separate clinical agreement. This coaching site is intended for a global audience and operates under a different scope of practice.
2. User Responsibility and Risks
You acknowledge that any lifestyle changes, exercises, or habits you implement based on our content are done at your own risk.
- Consult Your Physician: You should consult with a primary care physician or a local licensed healthcare provider before starting any new exercise or wellness program.
- Assumption of Risk: You voluntarily assume all risks associated with physical activity and lifestyle modifications discussed on this site.
3. AI-Assisted Content
You acknowledge that articles and resources on overfiftycoach.com are drafted using Artificial Intelligence (AI), synthesized from video presentations by Dr. Dave Candy, DPT. While we strive for high accuracy, we do not guarantee that all information is error-free or reflective of the most current medical research.
4. Payments, Cancellations, and Refunds
All financial transactions and payments are processed by Movement 4 Life Physical Therapy, LLC. Your charges will appear on your bank statement as ‘OverFiftyCoach’. In some instances, depending on the service or platform, you may see ‘Movement 4 Life’. By making a purchase, you acknowledge that your financial obligation is to the LLC, regardless of the brand name displayed.
- Payment: Fees must be paid in full prior to the start of any coaching session.
- Rescheduilng: We require at least 24 hours notice for rescheduling appointments. Failure to provide notice and/or repeated rescheduling may result in the forfeiture of the session fee.
- Refunds: Due to the nature of digital products and consulting time, refunds are not provided.
5. Intellectual Property
All content, including videos, transcripts, and custom graphics, is the property of Over Fifty Coach, Movement 4 Life Physical Therapy, LLC and David Candy. You may not reproduce, distribute, or sell our content without express written permission.
6. Limitation of Liability
To the fullest extent permitted by law, Over Fifty Coach, Movement 4 Life Physical Therapy, and David Candy shall not be liable for any direct, indirect, or consequential damages arising from your use of this website or coaching services.
7. Governing Law
These terms are governed by the laws of the State of Missouri, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Missouri.
